BOMSync, Inc. respects intellectual property rights and expects customers and Authorized Users to upload only material they have the right to use. This policy explains how copyright owners can report allegedly infringing Customer Data hosted through the BOMSync service, how affected customers may respond, and how BOMSync maintains its designated agent registration under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
This policy supplements the Terms of Service and Acceptable Use Policy. If anything here conflicts with the Terms, the Terms control.
1. Scope
This policy applies to copyright claims concerning content stored or transmitted through the BOMSync platform at the direction of a user or customer, such as BIM models, design files, drawings, attachments, images, specifications, and related project data.
It does not apply to claims that BOMSync's own software, documentation, trademarks, or branding infringe third-party rights. For those concerns, contact legal@bomsync.com or see the Intellectual Property Notice.
2. Designated agent (U.S. Copyright Office)
BOMSync, Inc. registered a designated agent with the U.S. Copyright Office on 13 September 2026. Copyright notices under the DMCA must be sent to the designated agent below. Information here matches our federal registration.

3. Notice-and-takedown procedure
If you believe that material on BOMSync infringes your copyright, send a written notice to the designated agent that includes all of the following (17 U.S.C. § 512(c)(3)):
- Your signature — physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work — describe the work you claim has been infringed, or provide a representative list if many works are involved.
- Identification of the infringing material — describe the material you claim is infringing and provide information reasonably sufficient for BOMSync to locate it within the service (for example: organization or company name, project name or id, file name, URL path within the app, date uploaded, and any other locators visible to the complaining party).
- Your contact information — mailing address, telephone number, and email address.
- Good-faith statement — a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement — a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
BOMSync may ignore notices that do not substantially comply with Section 512. We may share your notice with the affected customer and may redact personal information where appropriate.
Upon receipt of a valid notice, BOMSync will act expeditiously to remove or disable access to the material identified, consistent with applicable law and technical capability.
4. Notification to affected customers
When BOMSync removes or disables access to material based on a DMCA notice, we will make reasonable efforts to notify the customer or Authorized User who posted the material, including a copy of the notice (with personal contact details redacted where appropriate) and a summary of this policy.
5. Counter-notice procedure
If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notice to the designated agent (17 U.S.C. § 512(g)). Your counter-notice must include:
- Your signature — physical or electronic signature.
- Identification of removed material — describe the material that was removed or disabled and the location where it appeared before removal.
- Good-faith statement — under penalty of perjury, a statement that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Contact information — your name, address, and telephone number.
- Jurisdiction consent — a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, to any judicial district in which BOMSync may be found), and that you will accept service of process from the person who submitted the original DMCA notice or an agent of that person.
If we receive a valid counter-notice, BOMSync will forward a copy to the original complaining party. Unless the copyright owner notifies us within 10 to 14 business days that it has filed a court action seeking to restrain the customer from engaging in infringing activity relating to the material, BOMSync may restore the removed material or cease disabling access, consistent with Section 512(g).
6. Repeat infringer policy
BOMSync may, in appropriate circumstances and at its sole discretion, suspend or terminate access for customers or Authorized Users who are repeat infringers or who repeatedly upload material that violates copyright or other intellectual property rights. Factors may include the number of valid notices, severity, good-faith remediation, and contractual obligations. Termination may apply to an individual user, organization, or workspace as described in the Terms of Service.
7. Misrepresentations
Anyone who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f).
8. Agent registration renewal
Designated agent registrations with the U.S. Copyright Office must be renewed every three years. BOMSync's current registration date is 13 September 2026. Failure to maintain an active registration can affect safe-harbor eligibility for periods when the registration has lapsed.
